The Fund is required to compensate victims of the road even if the car stops

A walker is available by contacting the Trust Fund for road accident victims seeking compensation even if the investor has stopped (usually the Fund shall pay compensation to the victims of the "pirates of the road") but were not recorded his data. To say this is the Court of Cassation, which overturned a ruling by the Court of Appeals.

The motorist driving the car had called an ambulance and had stopped to wait for help and to assist the injured. Despite the time elapsed, it had not asked for references of others or the license plate of the vehicle, which eventually was dismissed. The victim was not nothing else to do but to turn to the Guarantee Fund.

The company was responsible for compensation but did not see the details and so had turned to the Court of Appeals. The ruling had legitimized this position, arguing that the fund was not required to pay the pawn because he had had ample time to identify your investor. The Supreme Court overturned this ruling on the other hand, imposing the compensation from the Guarantee Fund, as at that date the psycho-physical condition of the injured were not such as to enable him to take note of the number of license plates and identity of who was behind the wheel.
