Rating: No dangerous situation no bicycle forced

If no specific local threat situation exists, there is no obligation to use a separate bicycle path. This has established the Federal Administrative Court now taken a decision (ref. 3 C 42.09). As the German Bar Hotline reports that the city of Regensburg on the edge of the city for a shared pedestrian and bicycle traffic by putting up signs an obligation to use for cyclists had ordered.

The reason given was that would be harmed because of the lower roadway when overtaking cyclists, especially since the drivers often did not keep to the speed limit. This argument held the Federal Administrative Court in Leipzig to be too general. These accidents would also demonstrate that at this point no higher than average in danger for cyclists.

With the requirement to use a bike trail if it were the other hand, however, to restrict the traffic flow, for which strict conditions apply This includes going back to specific local conditions dangerous situation. This was, however, on the bend low and clear, not to see at night than the average well-lit roadway section.
