The Tar says no to tolls on motorways

The Administrative Court of Lazio has broken the government decree stipulating that some motorways were to be paid. Among the latter was also the ring road around Rome (GRA), which from May 1 next would be covered only by passing toll stations. The president of the province of Rome, Nicola Zingaretti, had recourse to the TAR with 27 mayors to cancel this decision.

A similar motion was presented by the provinces of Florence, Rieti, Ferrara and Pescara and the region of Tuscany. "The decree of June 25, 2010 - led to the judges - did not take into consideration that there were people who walked these streets without going into the highways. The decree, then, also violated the EU rules." In essence.

There would be toll or toll stations in areas not directly or though not necessarily interconnected with a network of highways, which would lead motorists to pay for a service (or structure) that would not have benefited. The ruling yesterday came after a long and tortuous process: July 29 last year, the Tar had suspended the decree, arguing that the same appeared to be merely a tax, whereas the payment was to pay a service.

At the end of the summer holidays, September 1, the Council of State had ruled that the decision of the TAR did not refer to the whole country "but only to the individual road segments of interest to applicants strata of local authorities." After just three days, a new order of the administrative courts of first instance granted the request of the Movement of the Citizen Defense extending the stop of the increase to the entire country.

Yesterday, finally, the final decision.
